Personally, I liked the Toby Maguire version better.

I thought the Toby movies were pretty silly which is why I kinda like Spider-Man 3 but a more serious route is certainly better.

I didn't.
But they both had their positives and negatives.
The new one was closer to the original Lee and Ditko and Ultimate comics.
But the 2002 version had a better Aunt May, who participated more in the plot.
Andrew Garfield was meeker and much more awkward, as was Peter Parker in the comics.

How can you think that the Toby Maguire movies were better? This one is MUCH more realistic, Peter now looks like the awkward, langly nerd he was in the comics, and he's got his webshooters back. Sure Aunt May played a bigger part in the 2002 version, but Peter's parents play a huge and influencial role in this move, 10X bigger than the first film. Plus, they wrote away the entire wrestling part of the story, which seems laughable in this day and age to have in a story, of any caliber.

It took forever to get to the point, but when it did, it was good.
