ARTICLE I - LEGISLATIVE OPERATIONS

Section I: All legislative powers belong to the Legislature of the State of Firestone, consisting of the House of Representatives, the Senate, Speaker of the House and Lieutenant Governor.

Section II: The Lieutenant Governor of the State of Firestone shall also be recognized as the President of the Senate in the State of Firestone. The President of the Senate is not a Senate member and only serves as the presiding officer. (See Section IX)

Section III: The House of Representatives shall be elected every four (4) months. Eleven (11) Representatives shall be elected, one of whom shall become the Speaker of the House. The Speaker of the House must have been elected by a Representative in the same term he/she will be the Speaker of the House. The terms of the election of the Speaker of the House should be left at the discretion of the Governor of Firestone. Any vacancy in the House of Representatives should be filled by an election held by the Speaker of the House of Firestone. Any vacancy in the Speaker of the House should be filled by an election held by the Governor of Firestone.

Section IV: The House of Representatives and Senate shall serve four (4) months fixed terms, but are obligated to remain in office until such a time a new House of Representatives and Senate can be elected.

Section V: Before a session of either chamber can commence, ½ of that chamber must be online and a super majority (⅔) of that must be present for roll call and voting.

Section VI: A bill can be presented in either the House or Senate and must obtain the approval of both houses of the State Legislature before being signed or vetoed by the Governor of Firestone. A bill requires a simple majority (½) in order to be passed.

Section VII: The presiding officer shall refrain from voting in his/her respective house unless there is a tie. In any event of a tie in the voting proceedings, the presiding officer shall break that tie. A nay results in the failure of the bill whereas an aye results in the passage of the bill and an abstaining will result as not voting for the bill.

Section VIII: In the event that the Speaker of the House resigns his/her position, he/she will remain in the House of Representatives as a Representative. The House would then elect a new Speaker of the House.

Section IX: The Legislature of the State of Firestone may override a veto or executive order issued by the Governor of the State of Firestone with a supermajority(⅔) vote from both chambers of the State Legislature.

Section X: Impeachments of any elected officials, members of the executive branch, or judicial branch must initiate in the House of Representatives. The House of Representatives shall vote on said impeachment. If said impeachment passes the House of Representatives with a supermajority (⅔), the impeachment shall move to the Senate for trial. The Senate shall then either convict or acquit the individual(s) being impeached. A supermajority (⅔) shall be required to convict or acquit the individual(s) being impeached. Members of Congress can be expelled. If it is a congressperson who is being expelled, only the house of Congress where he/she is elected must vote on said congressperson’s expulsion. A supermajority (⅔) must still be reached to convict or acquit said congressperson.

Section XI: The State of Firestone’s Constitution and Bill of Rights may be amended with a supermajority(⅔) vote in both chambers of the State Legislature. The Governor is not required to approve these amendments.

Section XII: The Senate must confirm all cabinet officials, judges, and other department officials with a simple majority (½), although certain cabinet positions shall be exempt from the requirement of a simple majority Senate confirmation. The positions exempt from the requirement of receiving a Senate confirmation shall be: the Chief of Staff.

Section XIII: The Lieutenant Governor, otherwise known as the President of the Senate, may appoint a member of the Senate to be the President Pro Tempore. A Pro Tempore is permitted to act as the Presiding Officer during a session of their chamber. The Speaker of The House may select a Representative to do the same, and the Representative chosen shall be known as the Speaker Pro Tempore.

Section XIV: The Presiding Officer of a Congressional session may hand over their role as Presiding Officer to another individual. This may be retrieved by simply demanding it back.

Section XV: The Lieutenant Governor is allowed to debate and request motions within the Senate when not serving as the Presiding Officer, although may not partake in the final voting of any legislation. When an individual is serving as the Presiding Officer, they may not request motions or directly debate, and is not permitted to vote on legislation, unless there is a tie.

Section XVI: House or Senate Resolutions may only pertain to the chamber they represent, and are only required to pass that specific chamber to go into effect. A Joint Resolution should pertain to both chambers and are required to pass both chambers to go into effect.
