Nintendo is terrible when it comes to fan games.
Both companies do the unethical practice of bricking consoles, But at least Sony isn't bad enough to hate their own fans and destroy their work.
They took down so many fan games that it's hard for me to support them.
Nintendo didn't give the fan developers permission to put up the games in the first place. Neither did they give permission to use Nintendo Propreties.
What if you worked day and night over and over, pretty much ruining your life to make your game (which is hard to make in the first place BTW), but then someone comes, plays your game, makes a game based off that, and the fan game makes more money than you do. Even worse, what if they don't even credit you for it, or create more games that destroys your game's cannon, or the public's understanding of your game? That would suck for you, and that's what Nintendo wants to prevent with their games. Seems a bit greedy, but what if you were Nintendo?
Oh yeah, Nintendo is original. They don't directly base their systems off other companies technologies.

I've never once seen a fan game that wasn't free or failed to credit the original creators. And nobody is stupid enough to mistake a fan game for canon.
As seen in the Legacy WoW community, Making a revival of an older version of another game pay to win is frowned upon, That's the closest argument I could make since NOBODY is stupid enough to charge for a fan game.
