In our current constitution, we lack the essentials any constitution shall have: a comprehensive description of the makeup of the government. What we have is simply a watered down version of the Bill of Rights.
Article I. THE LEGISLATIVE BRANCH
Section 1. All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a single House of Representatives.
Section 2. The House of Representatives will be comprised of [debate the number here] (Suggestion: the number of representatives will be equal to half the population, then divided by 5. Also, the House will be required every two elections to change the number of representatives based on how large the group grows).
Section 3. The House of Representatives will be divided into two classes, each class being elected every [Term Limits for Congressmen]. Each class will be elected in the middle of the opposite classes term.
Section 4. No person shall be a Representative whose account shall not have attained to the age of sixty days, and been one month a citizen of Robloxia.
Section 5. The House of Representatives shall have the sole power to impeach and try all impeachments. When sitting for that purpose, they shall be on oath or affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no person shall be convicted without the concurrence of two thirds of the members present.
Judgment in cases of impeachment shall not extend further than to removal from office, and disqualification to hold and enjoy any office of honor, trust or profit under Robloxia: but the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law.
Section 6. The House of Representatives shall have the sole power of ratifying international treaties and formally declaring war.
Section 7. The House of Representatives shall have the power to determine their own rules for their proceedings. However, they must have a minimum of a simple majority in cases involving a vote.
Section 8. The House of Representatives may regulate voting laws.
Article II. THE EXECUTIVE BRANCH
Section 1. The executive power shall be vested in a President of Robloxia. He shall hold his office during the term of [Congress shall debate this when we ratify the constitution], and, together with the Vice President, chosen for the same term, be elected, as follows: the person whom aquires the greatest number of individual votes from citizens of Robloxia will be the President. In the case of a tie, or lacking more than 2/5 of the vote, the House of Representatives will vote on the President and Vice President.
The President and Vice President shall be elected on the same ballot.
Section 2. No person shall be elegable for the office of the Presidency of Vice Presidency whose account has not attained ninety days of age and whose been a citizen of Robloxia for fewer than two months or who has not been a citizen at the addoption of this Constitution.
Section 3. In the case of removal, the Vice President shall be the replacement. The President may delegate his authority to the Vice President for an extended period for which he will be absent. The President will be required to write a formal delegation letter for Congress.
Section 4. He shall have power, by and with the advice and consent of the Congress, to make treaties, provided two thirds of the Congressmen present concur; and he shall nominate, and by and with the advice and consent of the Congress, shall appoint ambassadors,public ministers and consuls, judges of the Supreme Court, and all other officers of the United States, whose appointments are not herein otherwise provided for, and which shall be established by law: but the Congress may by law vest the appointment of such inferior officers, otheras they think proper, in the President alone, in the courts of law, or in the heads of departments.
The President shall have power to fill up all vacancies that may happen during the recess of the House, by granting commissions which shall expire at the end of their next session.
Section 5. He shall from time to time give to the Congress information of the state of the union, and recommend to their consideration such measures as he shall judge necessary and expedient. He shall receive ambassadors and other public ministers; he shall take care that the laws be faithfully executed, and shall commission all the officers of Robloxia.
Section 6. The Vice President will be the President of the House of Representatives, and preside over House Proceedings, however he may only vote if there is a tie.
Article III. THE JUDICIAL BRANCH
Section 1. The judicial power of Robloxia, shall be vested in ### ####### ###### who will be granted the power of the law of the land, meaning their rulings will apply to all of Robloxia, and in such inferior courts as the Congress may from time to time ordain and establish.
Section 2. The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the Robloxia, and treaties made, or which shall be made, under their authority.
Section 3. The Supreme Court shall have 1 year appointments. The President will nominate justices, and the House will confirm them with a simple majority.
Section 4. The Supreme Court shall consist of an odd number of justices. In the case of vacancy or absence, the President must make a nomination within 7 days, or the House will have the power to confirm a justice of their choosing without the Presidents nomination.
After a no#ination by the President, the House will have 7 days to confirm a ju#tice. If no justices are confirmed, the President shall make his own appointment without confirmation.
If the House denies three nominations, the remaining Supreme Court justices, if an even number exists, shall exclude the youngest member of the court and make their own appointment.
Article IV. AMENDING THE CONSTITUTION
Section 1. The constitution shall be amended with Amendments. They shall be added to the Constitution with a simple majority in the House of Representatives, and the approval of the President or Vice President.
If a 3/5 majority is reached, the President will not need to approve.
Section 2. An amendment may be passed without the House of Representatives if a petition with (number determined by congress) is reached.
FINAL NOTES:
This Constitution is clearly not complete. It is lacking a Bill of Rights. I know members of Congress will be wanting this, and I am proposing, with the adoption of this constitution, the first orders of business be to complete the constitution and incorporate a Bill of Rights.
