NATIONAL SECURITY AGENCY REPURPOSING ACT

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
PREAMBLE:
Recently an injunction against the National Security Agency by the Honorable Associate Justice SamuelKing22 has deemed it unlawful for an agent to make arrests within United States cities because the National Security Agency is not considered a law enforcement agency. This injunction has brought up even greater issues questioning the overall purpose of the National Security Agency. While the Director of the National Security Agency concedes that his agency is not a law enforcement agency and does not hold the authority to make arrests or act on United States soil, it is in the best interests of the National Security Agency and this country to pass this bill to re-purpose the agency to better fit with what is needed in our United States, which often differs from the needs of the real United States. Since the Central Intelligence Agency is strictly a foreign intelligence agency and the United States is not in a state of war, there is a lack of need for a second foreign intelligence agency, but it would be useful to have another as a backup in case of any foreign threats. The highly competent personnel of the National Security Agency are beyond capable enough to aid in the fight against domestic threats in conjunction with the Federal Bureau of Investigation and the Department of Homeland Security. It would be ideal for the National Security Agency to be re-purposed into a domestic intelligence and law enforcement agency since domestic terrorism has always been a major issue at our cities, and the extra personnel would be able to provide a more active law enforcement presence at United States cities and assist with intelligence gathering against domestic threats. Furthermore, it wouldn’t be feasible or ethical to disband such a large and historically important agency of the United States, which is why the agency is requesting to be repurposed so they may remain relevant and vital to the defense of our nation both during times of peace and times of war. For the betterment of our nation, I urge all to vote aye on this crucial piece of legislation.
SECTION I: NAME CITATION
(a) This bill shall be known as the ‘NSARA’.
SECTION II: ARRESTING AUTHORITY
(a) 50 U.S. Code § 3609 is hereby void.
(b) National Security Agency personnel now have the authority to make arrests.
(1) The Director of the National Security Agency may authorize or limit arresting powers granted to agency personnel as he or she wishes. (c) The exercise of arresting powers granted under subsection (b) in section II shall be limited to those circumstances where such personnel can identify specific and articulable facts giving such personnel reason to believe that the exercise of such powers is reasonable.
SECTION III: AGENCY DESIGNATION
(a) The National Security Agency is now designated as a domestic law enforcement and intelligence agency within the Department of Defense.
(1) Designation as a domestic intelligence agency does not exempt the National Security Agency or its personnel from any established laws including, but not limited to, any and all privacy laws.
(b) During times of war or when seen as necessary by the President, Secretary of Defense, or the Director of National Intelligence, the National Security Agency may act as a foreign intelligence agency similar to that of the Central Intelligence Agency.
(c) Subsection (b) of section III is not intended to divert the authority of the Central Intelligence Agency to the National Security Agency, but to allow the National Security Agency the authority to assist in foreign matters in collaboration with the Central Intelligence Agency when necessary.
SECTION IV. EFFECTIVE DATE
(a) This bill shall go into effect upon the passing of both chambers of congress and the signature of the President.
