PREAMBLE
The Federal Courts and Supreme Court should not oversee Military Cases. Military Cases and Federal Cases are two VERY different things.
SECTION I. Establishment
The Judge Advocate General Corps shall be established within the United States Military and will have judicial power over all five branches of the Military: Air Force, Army, Navy, Marine Corps, and Coast Guard (if applicable).
SECTION I. ARTICLE II. Powers
The Judge Advocate General Corps will be tasked with overseeing and enforcing 10 U.S. Code Chapter 47 - Uniform Code of Military Justice.
SECTION I. ARTICLE III. Military Court Proceedings
The Judge Advocate General Corps will oversee ALL Military Cases within US Military Property or in cases when the defendant represented the US Military that included in the defendant breaking US Code other than 10 U.S. Code Chapter 47.
The only exclusions to this article is, If the Defendant acted on Citizen Soil without representing the US Military. The Defendant is being prosecuted by the Attorney General. The Defendant and Plaintiff/Prosecution both agree to move to Federal System.
SECTION II. Judge Advocate General
The Judge Advocate General will act as the Chief JAG for the corps and can only be appointed by the President with majority approval from the Senate.
SECTION III. Associate Judge Advocate General(s)
Associate Judge Advocate Generals will act on cases within their own branch (unless otherwise stated by JAG Chief then there will be a Joint Case). The AJAG(s) are to be appointed by their branch Joint Chief of Staff. There is a AJAG for every branch except the Marine Corps; the Navy JAG acts on cases for Marine Corps and the Navy.
SECTION IV. Judge Advocate General Powers
Judge Advocate Generals have the same powers as Federal Judges but are restricted to be used only in the US Military.
They however cannot order declassification of documents or order the Federal Imprisonment, AOS, or KOS of a defendant. They may only issue warrants to Military Imprisonment and Discharges.
SECTION V. Military Prosecutors
Military Prosecutors may prosecute Military Members in the Military Court System for their own branch.
SECTION V. ARTICLE II. Branch Military Prosecutors
The Designated Positions for Military Prosecutors are as follows,
Air Force : Chief of the Air Force Security Forces Army : Army Provost Marshal General Marine Corps : Master At Arms Commander Navy : Master At Arms Commander
EFFECTIVE
Upon passing from both chambers and signature from the President, this will repeal the previous JAG Reform Bill and be effective three days after signature.

whoopsies, the constituion, article III, both section 1 and 2 forbid any cases to be done somewhere else other than the federal courts.
If this passes (which it won't) SCOTUS will strike it off. |
