Greetings Citizens,
Recently in the military, the Judge Advocate General Corps has been reestablished. This provides the United States Military with a sound legal body to moderate all branches under the law. Currently, the Judge Advocate General Corps is under the Department of Justice, and in turn, the federal courts. This means a few things.
Firstly, all military cases are put into the queue in the civilian court system. This results in extended periods of time before any action is taken on the cases, and an elongation to a system that could be shortened immensely under United States Military, Judge Advocate General control.
Secondly, the United States Department of Justice and Federal Courts operate under the U.S Code and civilian law. The Military operates under the United States Uniform Code of Military Justice. These are two separate law forms, the latter being one in which the federal court judges and attorneys are not trained in. This means that cases taken by civilian judges and lawyers for military issues are met by ignorance and confusion.
Thirdly, we currently have a functioning legal body within the Judge Advocate General Corps. Keeping the Corp under civilian control would burden the people within the Corp. We all know that most judges taking cases are either busy or inactive. That means extremely long waiting times for warrants, court orders, trials, etc.. The Department of Justice is already dealing with as much as it can handle. Adding the Judge Advocate General Corps would mean overburdening the Department. Most likely, the Corp would take a seat below everything else, making it a third, fourth, or fifth priority to the leaders of the Department of Justice.
The Judge Advocate General Corps is a military entity used to organize and manage Military law. People serving in the military are not civilians. They deserve a system that fits their job description and goes along with what the military expects legally. The Military should not be under civilian law because it simply isn't a civilian body. I urge Congress to pass a bill approving the Judge Advocate General Corps, putting the Corps under Military control, approving the Judge Advocate General Corps to operate under the Uniform Code of Military Justice, and to approve all judges currently riding the circuit for the Judge Advocate General Corps which can be found within the JAG groups. (Joint Force Judges, AJAG, and JAG)
I honestly feel this is a simple decision. Put military matters where they belong, and please, sign this petition to put the JAG Corps where it belongs. Thank you.

Who knew one sentence could have so many inaccuracies? Firstly, the JAGC is _not_ under the Department of Justice. Neither are the federal courts.
The Department of Justice PROSECUTE criminals in the Federal Courts. It would be a HUGE breach of checks and balances if the courts were at the mercy of the prosecution. In that scenario, every defendant would be found guilty.
I must admit I'm not familiar with the hierarchical structure of the US Military. However, I am quite confident that the JAG is an internal system within the military, and is not directly related to the DoJ. If there is evidence otherwise, please let me know, and I'll review. |

| I did not say the DoJ was under the Federal Courts. I said, the JAG Corps is. Right now, until Congress passes a bill that allows the JAG Corps to run under the military, our cases go to the federal court system. As well, the Department of Justice provides prosecutors and public defenders. That's the system that was presented to us by the Department of Justice, and one which can be resolved quickly if Congress and the President act now. |

"our cases go to the federal court system" Alright, this is a genuine problem, and should most definitely be sorted. Military matters should be dealt with in a separate system.
"the Department of Justice provides prosecutors and public defenders" I don't particularly take issue with this, since the DoJ has a wide range of legal capabilities. But if the military doesn't like it, who am I to support keeping it?
