This forum is intended for Judges only, however, all citizens of Windsor may view it to ensure their case is fair and just.
Step 1: The Judge of the case announces for everyone in the courtroom to rise, and then sits in his/her seat.
Step 2: Judge tells everyone in the courtroom to sit, and then announces the name of the Defendant Party, as well as the charges he/she is facing.
Step 3: Judge announces the name of the Prosecution Party.
Step 4: Judge informs the *possible* Jury and audience what the Defendant faces if he/she loses the case.
Step 5: Judge informs the Defense and his/her *possible* attorney to rise, and swears them both in. Judge then does this to the Prosecution afterward.
Step 6: Judge tells the Prosecution to begin their Opening Statement, as well as to inform him/her to mention all forms of evidence they may have to prove their case. Judge must also inform the opposing party that objections may not be made during Opening and Closing Statements.
Step 7: Judge tells the Defense to begin their Opening Statement, as well as to inform him/her to mention all forms of evidence they may have to prove their case. Judge must also inform the opposing party that objections may not be made during Opening and Closing Statements.
Step 8: Depending on how long Opening Statements take, Judge announces First Recess for either 2-5 minutes.
Step 9: Judge announces to the courtroom that the First Recess has concluded, and announces all parties to reenter the courtroom, and to take their seats.
Step 10: Judge tells the Prosecution to present their side of the story, as well as use the evidence they had previously mentioned to prove their case. Objections may be made on the opposing party, only if the Judge approves.
Step 11: Judge tells the Defense to present their side of the story, as well as use the evidence they had previously mentioned to prove their case. Objections may be made on the opposing party, only if the Judge approves.
Step 12: If objections are made, and are approved, the party that called the objection must prove the statement false/ true based on their own knowledge/ evidence.
Step 13: Judge announces Second Recess, which, again, depending on how long the parties take, will either last 2-5 minutes long.
Step 14: Judge announces to the courtroom that the Second Recess has concluded, and announces all parties to reenter the courtroom, and to take their seats.
Step 15: Judge announces for the Prosecution to begin their Closing Statement, and reminds the Defense again that Objections may not be made.
Step 16: Judge announces for the Defense to begin their Closing Statement, and reminds the Prosecution that Objections may not be made.
Step 17: Judge informs the *possible* Jury to leave the courtroom, and to wait outside the deliberations room until they are let in by the Judge.
SIDE NOTE: If the case is a Jury Trial, the Jury will meet and deliberate a verdict on whether or not the Defense is guilty or not. If the Jury is half-and-half on a decision, the Head Juror (randomly selected Jury member) informs the Judge that the Jury is in "Hung Jury." Hung Jury means that the Jury may have as much time as they need until everyone agrees on one side. If there is no Hung Jury, the Jury may meet for no longer than 10 minutes.
Step 18: If the case was a Bench Trial, then the Judge leaves the courtroom to decide on a verdict, as well as a proper, if any, punishment. No Judge may defy Amendment VIII of the US BoR.
Step 19: If the case is, again, a Bench Trial, the Judge announces the verdict and the *possible* punishment to the Defense. If the case is a Jury Trial, the Head Juror announces the verdict, and the Judge announces a punishment based on the severity of the crime committed.
Step 20: Judge announces case is closed, and for all parties to rise.
Step 21: Judge leaves courtroom and messages the City Attorney the following:
NAME OF CASE ("Defense Person" VS "Prosecution Person")
- Date of Case - Which side won - Crime committed - Punishment (time in jail) to be administered (if none, write "N/A")
Signed, Judge (Your name)
I hope this clarifies everything on how exactly Windsor cases *should* be handled, I expect Judges to follow these instructions step-by-step.
Signed, WCGDC City Attorney, RandallCountySWAT
