Use of Lethal Force and Arrest Protocol Bill Proposed by Moonbilly
Introduction: This bill will control the actions of law enforcement agencies, protect civilians from unreasonable arrest or death from agencies. This will be a structured process where the civilian is told the reason for the punishment received. For all inquires about definitions of anything mentioned in the bill please refer to Section 3 or contact the Department of Justice for interpretation.
SECTION 1: Arrest Protocol An arrest may be made in accordance to any laws approved by Congress, and at the discretion of a law enforcement officer while following this protocol:
Section 1a: Minor Crime: 1. Warn the perpetrator to stop committing the offense (Minimum three warnings) 2. Tase (See Section 4) the perpetrator, along with a strong verbal command to stop, arrest warning may be given here. 3. Tell perpetrator reason of arrest, read his/her rights (if possible), then arrest perpetrator. 3. If the perpetrator was not read his/her rights or reason for arrest, if a Bureau of Prison Staff member is in the game, then they must read the rights or reason of arrest to the prisoner in their cell, unless they have bailed.
Major Crime: (Note: if the perpetrator is being violent and is causing harm to law enforcements officers and/or bystanders this may warrant lethal force, see Section 2) 1. Tase if needed to conduct the arrest. (optional) 2. Tell perpetrator reason of arrest (if possible), read his/her rights (if possible), then arrest perpetrator. 2. If the perpetrator was not read his/her rights or reason of arrest, if a Bureau of Prison Staff member is in the game, then they must read the rights or reason of arrest to the prisoner in their cell, unless they have bailed.
Section 1b: If this bill is passed, the United States Secret Service shall receive Arrest tools at Washington DC, to ensure they provide better protection and to compensate for the restricted Lethal Force rules. For exceptions to this section please see Section 4.
SECTION 2: Lethal Force Protocol
The law authorizes law enforcement officers to use deadly force only when they reasonably believe it is necessary to defend themselves or a third person from the use or imminent use of deadly physical force or to make an arrest or prevent the escape from custody of a person whom they reasonably believe has committed or attempted to commit a felony involving the infliction or threatened infliction of serious physical injury and, where feasible, they have given warning of their intent to use deadly physical force.
All uses of deadly force MUST be reported on the radio to the highest ranking officer on server or must be posted on the agency group wall. For exceptions to this section please see Section 4 SECTION 3: Definitions
Minor crime: crime that generally has no victim, or has a low effect to the server and/or country. This includes but is not limited to tool theft (not including firearms or weapons), battery (verbal abuse), trespassing on private property (excluding the White House or other high level government buildings), and harassment.
Major crime: Crime that inflicts damage to another player or another players property, vehicle, weapon theft and illegal weapons trafficking and/or position of illegal weapons also fall under this category.
Taser: Anytime the item “Taser” is mentioned in the article, it refers to any tool used by law enforcement that temporarily disables a character.
Weapon: Anytime the item “Weapon” is mentioned in this article, it refers to a tool or gear that can be used to effect another player in game.
Section 4: Exceptions
All individuals who are in the AoS/KoS rank in the USA group are subject to immediate arrest, use of lethal force, and removal by an admin.
Perpetrators are subject to be placed on a 'server wide AoS/KoS' by any of the following: Law Enforcement Deputy Director+ (or an equivalent rank) Department of Justice Staff
Section 5: This bill takes effect as soon as it is passed through Congress.
