A BILL TO Properly establish the need, process and procedure of a By Election and what situations would trigger a need for a By Election and specifies when a seat may be directly appointed mid-term. ▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬ BE IT ENACTED by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal and Commons, in this present Parliament assembled, and by the authority of the same, as follows: -
1 Introduction and establishing need for Mid-Term Seat Appointment It’s not uncommon to see a seat be vacated or simply abandoned in the middle of the term. It’s simple really, an MP for party a defects to party b and due to the lawless nature and lack of enforcement, they are allowed to keep their seat and sit in that seat as party b. This is not only an ethics issue, but it’s betraying and defying the people of the United Kingdom. They wouldn’t have voted for party a if they would want party b to have such seat, but party a got elected by the British People to that seat for that party. That is why we are presenting this bill; - To make sure the people’s voice is not mutilated by an MP saying they want to defect - To create more fairness and enforcement within the Parliament on how vacated seats are handled ▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬ 2 Situations that would automatically vacate seats and would require a Mid-Term Seat Appointment: (1) Seat Appointment due to Party Defection (a) Defining realm of Party Defection: Party Defection is the event where one MP appointed to a seat by a Party further “switches” parties and is no longer a member or MP for that party. (b) In the event of a Party Defection, that seat will automatically be vacated and the sitting MP would be kicked from Parliament. However, the seat will still be entitled to the party that saw a defection. The seat may be appointed by the Party Leader of the party that holds the seat. (2) Midterm Seat Appointment due to Resignation (a)Defining realm of a Mid-Term seat appointment: A Mid-Term Seat Appointment may be authorized if a Member of Parliament for a specific party’s seat resigns or retires. (b)In the event of a resignation or retirement of a seat, the Party Leader and only the Party Leader will have the power to appoint a new Member of Parliament to fill that vacated seat. Resignation or Retirement will not signal the loss of that seat from the party. (c)The MP that resigned or retired may not hold a seat in a current Parliament until the next Parliament is formed (Another General Election) ▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬ 3 Process and procedure of a Mid-Term Seat Appointment (1) Procedure and Process in the event of a Mid-Term Seat Appointment (a) Once a seat get vacated due to resignation, retirement or defection, the Party Leader of the party responsible for that seat will be permitted to appoint another Member of Parliament in place of the outgoing member. ▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬ 4 In the event of Speaker resignation (1) If the Speaker of the House resigns mid term, there will be two circumstances in such event: (a) Speaker resigns speakership and is allowed to go back and sit with the party as an MP he/she was with before becoming Speaker of the House (b) Speaker can resign Parliament as a whole. In the event of the Speaker resigning in Parliament, the speakership will go up for election and the vacated seat left by the Speaker will go up for a by-election. ▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬▬ 5 Short title, commencement and extent SHORT TITLE: This bill shall be further known as in short as the “Mid-Term Appointment Act” COMMENCEMENT: After Royal Assent is granted to this bill, the Bill will go immediately into effect. |
