WHEREAS Federal Courts were biased, inactive, and incapable due to lack of numbers, interest, and ability.
WHEREAS Attorneys of Law were inactive, and a lack of Attorneys was present.
WHEREAS investigations were not held prior to criminal and civil trials, creating a lack of evidence.
WHEREAS jurors were not selected using a formal process.
WHEREAS Court Trials were held with very little time in advance for the Prosecution or Defense to gather evidence, attorneys, or witnesses, creating a bias to the Prosecution.
The Federal Court System Reformation Act aims to fix the flaws evident in our judicial system.
SECTION 1: Short Title
a). This bill shall be referred to as the The Justice Department Reformation Act of 2015.
SECTION 2: Establishment of the Federal Court System
a). An existing group, the U.S. Courts, shall hold all federal judges.
b). This group shall be held and operated by AmericanPatron, administrated by an appointee of the President of the United States.
c). The following ranks shall be made in the group;
- AmericanPatron
- President of the United States
- Vice President of the United States
- Chief Justice
- Associate Justices of the Supreme Court
- Judges of the Federal Courts
- Judicial Staff
d). Under this legislation the amount of Federal Justices will be increased to a max of 7 and a minimum of 5.
e). Under this legislation the amount of Supreme Court Justices will increase to a max of 5 with a minimum of 3.
f). All Federal Judges and Supreme Court judges have to be competent in law, and follow it correctly.
SECTION 3: Establishment of Attorney's in the Judicial System:
a). The Deperatment of Justice shall be responsible for the training and hiring of attorney's in the Justice field.
b). The Deperatment of Justice shall also be responsible for the administration of these attorney's under the leadership of the Attorney General.
c). Attorney's shall be used in trials and other justice hearings that includes a client, if the client denies an attorney he or she will not be subject to be there.
d). Should a client be denied an attorney or is dealt justice without being represented correctly Department of Justice shall have repercussions.
SECTION 4: Reformation of Juries and Jury Selection Article 1: Jury Selection
a). The Department of Justice shall handle all matters concerning the selection of juries.
b). 12 Potential Jurors shall be chosen by the seated judge and summoned to a jury selection.
c). The seated judge shall then narrow down the jurors to six jurors. Attorneys shall, if needed, object to a juror, at which point the judge may confirm or deny the objection based on the given argument from the attorney.
d). The remaining six jurors will form the jury of said trial.
Article 2: Jury Proceedures: a). The jury shall elect a foreman, and he/she shall speak for the jurors.
b). The jury shall be present for the entire trial. The trial cannot continue if 6 jurors at any time are not present. If a juror leaves mid trial, the seated judge shall choose a juror from the available audience. Attorneys may object if needed, as cited in Section 4 Article 1 line c.
c). The jury will be given all time needed to discuss a verdict following the closing of the trial.
d). The jury must be unanimous in it’s ruling. In the event of a split jury, the trial shall be declared a mistrial, and a new trial with new jurors shall occur.
e). The jury shall recommend a sentence to the judge appropriate to the crimes convicted, but the sentencing powers are fully given to the sitting judge.
SECTION 5:Establishing Investigations Regarding Crimes:
a). If a person is suspected of committing a crime, but was not arrested, the Justice Department shall henceforth hold investigations, conducted internally, to gather evidence against the said person in order to constitute an arrest.
b). Investigations will last no longer than two weeks, after which the Justice Department must decide whether or not to prosecute.
SECTION 6: Date of Effect a). This bill will go into effect immediately if passed.
