Italy NEEDS a court system!

Why? I am sure everyone has had their moment where they feel as if their side of the point doesn’t matter. And that is FACT. Currently, the Carabinieri are the only ones who decide ones punishment for said law breaking on a day to day bases. Although this may be faster, it can lead to a lot of disagreement.

A good court system does not mean that the Carabinieri will have to consult the court before making an arrest. Everyone knows that just doesn’t work on Roblox. However, before someone is made a most wanted citizen, their needs to be a trial. One shouldn’t be able to declare someone a national threat without any article of evidence. This court system would hopefully add a third party that could make decisions without any bias.

My Idea for a court System:

Article 1: Court Uses

A court case should not be used for every arrest. Instead, it should be used for any large cases like declaring someone a national threat. A court case could also be used if a one were to try to fire or criminalize another person even though they aren’t a government official. Lastly, the final reason one could use a court case is to fire or criminalize a government worker/official who they believe broke the law in a severe case, or falsely arrested/accused another person.

Article 2: Court Ranks

Legal General: Responsible for organizing all court cases and assigning a judge and time to each court case.
Judge: Responsible for Overseeing a court case and making sure all goes well.
Juror: A civilian who has been selected to make an unbiased decision in court.
Attorney General: Responsible for overseeing all Attorneys. This rank decides how one becomes an attorney. Also responsible to oversee that each Attorney does not become inactive.
Attorney: Independent worker for hire by civilians going to court. Responsible to be the citizen’s voice in court.
Security General: Responsible to decide how security is selected. Responsible to oversee the security of all courts.
Security: Responsible to keep each court safe, lightly armed and only has authority in-court.
Witness: Italian Citizens or Tourists who have been called to court because they r believed to have witnessed the event.
Minister of Justice: The Minister left in charge of the court system voted in by the people.

Article 3: Court System

Each court shall have 2 sides: the defense and the prosecution. The defense are the people who are being accused while the prosecution are the people accusing the defense. Each side shall have 1 attorney.
Every court shall have 6 jurors. In order to create the most unbiased decision possible, the judge will select 4 Jurors out of the amount of citizens in ITA. Each side of the court shall choose 1 juror from the citizens of ITA to create a jury of 6.
Once the court is in session, the judge shall take full authority over the room. The judge shall then ask the prosecution to make an opening statement about why they are prosecuting. Then the court shall proceed by the judge asking the defense why they believe they are innocent.
As soon as the opening statements are complete, the judge shall ask the prosecution to present their evidence of why the defense is guilty. This can range from calling a witness to the stand to presenting a screenshot to the jury, the judge, the defense, and the prosecution. The judge shall then ask the defense to present their evidence and points to deny their guilt. As soon as the defense finishes up their presentation of evidence, the prosecution can close by stating a short statement.
After the prosecutors make their closing statement, the jury are taken to a backroom where they are to decide whether the defendants are guilty or innocent. If the courtroom is tied, defense automatic wins.

Article 4: Defense and Prosecution Rights

1. The defense reserve the right to call a 15 minute Recess.
2. The prosecution reserve the right to object a recess from the defense.
3. The prosecution and defense can close the case early. The case will be considered a win for the defense.
Article 5: Judge Rights
1. Declare a recess of up to 30 Hours.
2. Force people out of the courtroom.
3. If there is not enough jury, the judge may make the decision alongside the amount of jury available.
4. Set time limits on sections of the court.

Article 6: Courtroom shape.

The courtroom shall be created so that the judge sits in the very front on a high pedestal. Looking outward from the judge’s seat, the jury should be on the left wall sitting down in a tiered stand with 3 seats in each row while the stand is directly in front of him. Behind the stand just to the left shall be the Defense table, seating 2 seats while on the opposite side of the defense is the prosecution, with 2 seats on the prosecutions side. On the right side, there shall be 6 seats all in a single row on the ground. At the very back of the courtroom, behind a fence, shall be an unset amount of seats for spectators.

Article 7: Witness Rules

1. Any side may bring a maximum of 3 witnesses to the court.
2. Any witness may be questioned by any side.
3. Witnesses may refuse to answer any questions.
4. The prosecutor and the defendant (not attorney) may be used as a witness.
5. Witnesses MUST attend court and must not lie in court.
6. When a witness is questioned, he/she must step up to the stand.
7. When a witness is asked to repeat, he/she must repeat.

Article 8: Standard Rules

1. No Interruption
2. No Directly speaking to the jury
3. Jury must stay quite
4. Spectators must stay quite
5. All personnel in the court must remain quite unless they are supposed to be speaking.
6. No rude behavior
7. No being Immature
8. Failure to comply with any courtroom rules will be severely punished.
Conclusion:
A court system is Italy would be a step closer to a people’s government. It may not be 100% effective, however it should be quite effective in stopping crime. If you agree with these policies, please sign this article and make sure you spread the news.

Numerous grammar and usage mistakes aside, Italy has tried many times in the past to have a court system which eventually fails.

No, the council does all major things involving criminals. This is kinda useless considering we vote on Blacklists, we vote on Unclearable- AOSes, this is basically the council's job. If you want to be a part of this, then try to join council. Plus we tried a court system but most civilians do not get evidence, therefore their requests were automatically denied. As for witnesses, it is incredibly easy to lie in an online game where you cannot easily show emotions, therefore witnesses are not credible. So if people refuse to get evidence and witnesses have a big chance of lying, then doesn't that make every court have a mistrial?

Hi, I'm a resident nerd/council member. Before the impending C&Gers show up, I'm here to dissect bits and pieces your argument.

Civilians hardly ever know what's going on due to a secure radio channel authorities use. Furthermore, if you legitimately do have a complaint, you NEED to forward it (with evidence) to Minister officials. Without evidence, claims are practically invalidated.

Ministers are hardly ever selected by the people. That may change in the future, but this minister will likely never be selected by the people.

Who says the judge wouldn't be biased? Who says whoever appointed the judge wouldn't be biased? The jurors will likely never be on, or be a part of the government anyway, and if the defense and the prosecution select a juror each, the juror will (most likely) always vote in favor of the side that selected them.

If the defense close the case, they still win?

Overall, this court plan has many flaws. Granted, most court plans have flaws, which is generally why we choose not to use them.

You can still totally protest claims, by sending it to the relevant authorities. For example, you can send me proof of ITAF abuse, if any. (Note proof does not solely constitute witnesses. I need photos/videos.)

If you don't think the minister cares about the evidence, go ahead and send it to me, and I'll forward it to them. Chances are, they receive a lot of PMs anyways.
