Hey everyone!
So, yes. I understand the Supreme Court is reviewing the methods of these elections, so I decided to take up the argument into case format.
Here is why I am against A.J. Ethancomputermad's proposition of the elections violating Artcle I; Section II.
A.J. Ethancomputermad's Statement;
- Congressional Class II House elections violate the Constitution. As specifically; "All electors shall have one vote"
Marinio's Statement;
- The only place in the Constitution Article I; Section II that mentions limitations to vote count is; "But in choosing the President, the votes shall be taken by states, the representation from each state having one vote--"
That is in the case of Presidential Elections. If neither candidate reaches the required 270 Electoral Votes for Presidency, the House is to receive the top 5 candidates for President, and EACH GETTING ONLY ONE VOTE, they vote on who will be the next President.
- I would also like to point out that the Constitution has no specific requirement for how many votes a citizen may deliver to individual candidates for Congress. This leads us to Article X of our Amendments which states; "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively."
This means that the states decides what will be their method of electing their own leaders. Usually this argument resides on whether the election will be a caucus or a private vote. But since there are no states, Congress (the one who technically represents the states) passed legislation stating; "Congress is to take the place of the state, in regards to deciding parameters of Congressional Elections, leaving initiatives alternative to each individual election."

| Wouldn't it be "The People vs Marinio" or "The State of ____ vs Marinio"? I didn't think the Supreme Court sued anyone, and if they did it wouldn't go directly to the Supreme Court anyways. |

Marinio, if you go against the Supreme Court, a. Your name goes first as does always the prosecution/plaintiff, so it'd be "Marinio v. Supreme Court" and b. It'd be an appeal, not a trial. You don't have a case about a decision or idea the court made, you appeal it to whatever court you expect to see this.
I didn't understand all of this since I don't know what's going on in your group, but you don't sue the Supreme Court, the title is wrong, and from what I understand from this, the closes title I could come up with for you is petitioner/appellant but that's only if you're arguing something to the Supreme Court anyways, but you'd appeal something else, you wouldn't title your appeal as you vs. the people deciding the appeal. It's more of Marinio vs A.J. Ethanwhatever and you'd appeal that. |

Actually, Ethan was the one that differed from my statement. This is my response to it.

Okay, your not suing anyone puts this into more of a perspective for me.
And since I really don't care about what goes on in the USA group I won't ask anymore to clarify how this should've been titled and I'll just let it be this. |
